Terms of Service
1. What Gym or Pay is
Gym or Pay is a personal accountability app. You set a weekly workout goal and a weekly deposit. If you hit your goal, your deposit is refunded. If you miss it, your deposit is donated in full to a charity you chose at signup. Gym or Pay takes no cut of missed deposits — the platform fee is charged separately and upfront.
2. Eligibility
You must be at least 18 years old and resident in a country where Stripe and Tremendous operate. The app is currently available in the EU and US.
3. Deposits and fees
Your weekly deposit (€1–€50) and platform fee are charged every Monday via Stripe. The platform fee is shown clearly before you start. Stripe's processing fees are included in the total you see — there are no hidden charges.
4. EU 14-day cooling-off right
If you are based in the EU, you have the right to cancel within 14 days of your first charge for a full refund, regardless of whether you hit your workout target. This right applies to your first week only. Use the cancel button on the Home screen or email hello@gym-or-pay.com.
5. Workout validation
Workouts are validated automatically from Apple Health or Google Health Connect. A workout counts if it is at least 25 minutes long, has an average heart rate of at least 120 bpm, was not entered manually, and started within the last 24 hours. We do not accept manual overrides.
6. Cancellation
You can cancel at any time. If you cancel between weeks, no further charges are made. If you cancel mid-week, the current week's deposit is donated to your chosen charity as if you had missed the target. No further charges are made after that.
7. Refunds
Refunds are issued only in two cases: (a) you hit your weekly workout target, or (b) you exercise your 14-day cooling-off right on your first week. Refunds are returned to your original payment method via Stripe. We do not issue cash refunds by bank transfer.
8. Limitation of liability
Gym or Pay is a personal accountability tool, not a financial product. We are not liable for any health outcomes, missed workouts due to injury, or third-party service outages (Stripe, Apple Health, Google Health Connect). Our liability is limited to the amount you paid us in platform fees in the 3 months before any claim.
9. Changes to these terms
We will notify you by email at least 14 days before making material changes. Continued use of the app after that date constitutes acceptance.
10. Governing law
These terms are governed by Portuguese law. Disputes shall be resolved in the courts of Lisbon, Portugal.
